Milwood Projects & Partners provides legal administration, legal operations, document support, legal research support and project administration services.
Regulatory Status
Milwood Projects & Partners is not a firm of solicitors and is not authorised or regulated by the Solicitors Regulation Authority (SRA) or another approved legal services regulator to provide reserved legal activities.
The provision of Legal Operations & Document Support by Milwood should not be interpreted as creating a solicitor-client relationship.
Our team may possess legal qualifications, including academic legal qualifications and specialist legal administrative training. Such qualifications do not, by themselves, constitute admission to the Roll of Solicitors or authorisation to undertake reserved legal activities.
Scope of Our Services
Services provided by Milwood may include:
legal and matter administration;
document preparation and formatting;
document organisation and indexing;
proofreading and consistency checking;
chronology preparation;
administrative case and matter trackers;
legal project coordination;
legal research for professional review;
legislation, case-law and regulatory research;
preparation of research summaries;
file and document management;
diary, deadline and action tracking;
legal PA and secretarial support;
client-onboarding administration;
case-management or CRM administration;
workflow and process documentation;
template and precedent administration;
reporting and management information; and
other non-reserved administrative and operational support agreed with the client.
The precise scope of each engagement will be agreed with the client before work begins.
Legal Advice
Unless expressly agreed under an appropriate lawful and professionally supervised arrangement, Milwood's Legal Operations & Document Support service does not provide legal advice to members of the public and should not be relied upon as a substitute for advice from an appropriately qualified and authorised legal professional.
Legal research, summaries, document support and other information prepared by Milwood are provided for administrative, research or professional-support purposes.
Where materials are prepared for a solicitor, barrister, in-house legal professional or other authorised professional, that professional remains responsible for reviewing the work and making any legal assessment, recommendation or decision arising from it.
Milwood does not determine a client's legal rights, provide an independent legal opinion on the merits of a case or advise a client on what legal action they should take through this service.
Reserved Legal Activities
Milwood does not independently undertake reserved legal activities for members of the public unless the activity is lawfully undertaken pursuant to an applicable statutory exemption or within another legally permitted arrangement.
Under the Legal Services Act 2007, reserved legal activities include:
the exercise of a right of audience;
the conduct of litigation;
reserved instrument activities;
probate activities;
notarial activities; and
the administration of oaths.
Accordingly, Milwood does not hold itself out as authorised to:
represent clients in court where a reserved right of audience is required;
independently commence, prosecute or defend court proceedings on behalf of a client where doing so constitutes the conduct of litigation;
undertake reserved conveyancing or other reserved instrument activities;
undertake reserved probate activities;
provide notarial services; or
administer oaths where this constitutes a reserved legal activity.
Where Milwood provides administrative support in connection with a matter involving a reserved legal activity, the reserved work must remain under the responsibility and control of the appropriately authorised legal professional or organisation.
Work for Solicitors and Other Authorised Legal Professionals
Milwood may provide administrative, research, document, operational and project support to solicitors, law firms, barristers, in-house legal departments and other appropriately authorised professionals.
Where work is performed in connection with regulated legal services, Milwood will work within the scope agreed with the instructing organisation and any applicable supervision, confidentiality, information-security and professional requirements.
The instructing authorised professional or regulated organisation remains responsible for determining whether particular work may lawfully be delegated and for providing any supervision, review or approval required by applicable professional rules or legislation.
Milwood's involvement does not transfer responsibility for reserved legal work from the authorised professional to Milwood.
Immigration Advice and Services
Milwood does not provide immigration advice or immigration services requiring regulatory authorisation unless the person providing those services is appropriately authorised or the work is undertaken within another lawful exemption or supervised arrangement.
Where regulated immigration advice is required, clients should obtain assistance from an adviser registered with the Immigration Advice Authority or another appropriately authorised professional.
Claims Management Activities
Milwood does not undertake regulated claims-management activities requiring authorisation from the Financial Conduct Authority unless the necessary authorisation or exemption applies.
This includes regulated claims-management activity relating to areas such as financial products and services, personal injury, housing disrepair and other categories falling within the applicable FCA regulatory regime.
Professional Responsibility and Reliance
Legal and regulatory matters can depend on the individual facts and circumstances of each case.
Clients should not use administrative documents, research notes, summaries, templates or other materials prepared through this service as a substitute for obtaining appropriate professional legal advice where such advice is required.
Responsibility for legal judgement, interpretation, strategy and decisions remains with the client and/or the appropriately authorised professional advising them.
Milwood reserves the right to decline, suspend or refer an instruction where:
it falls outside the agreed scope of service;
it falls outside our competence;
specialist professional advice is required;
the activity may constitute a reserved or otherwise regulated activity;
appropriate professional supervision is not available; or
continuing the instruction could result in a breach of law, regulation or professional obligations.
Confidentiality and Data Protection
Milwood will handle confidential information in accordance with its contractual confidentiality obligations and applicable data-protection requirements.
Where Milwood processes personal data on behalf of a client, the parties will establish the appropriate data-processing arrangements where required.
Clients should not assume that communications with Milwood independently attract legal professional privilege merely because the subject matter relates to a legal issue. Where privilege is important, the client should obtain advice from the solicitor or other authorised legal professional responsible for the matter and establish appropriate communication and instruction arrangements.
Regulatory Protections
Because Milwood is not an SRA-authorised law firm, clients should not assume that regulatory protections applying specifically to clients of SRA-authorised firms apply to services supplied directly by Milwood.
Where a service is commissioned by an authorised law firm or legal professional as part of that firm's regulated service to its client, the regulatory position and responsibility for the underlying legal service will depend on the particular arrangement.
No Guarantee of Outcome
Milwood does not guarantee the outcome of any legal matter, claim, application, negotiation, dispute, proceeding or other legal process.
Administrative assistance, legal research or project support does not guarantee that a particular legal or commercial result will be achieved.
Jurisdiction
This disclaimer relates principally to services provided in England and Wales.
Different rules governing legal services apply in Scotland, Northern Ireland and other jurisdictions. Milwood will not represent that an England and Wales legal-services framework applies to work in another jurisdiction without first establishing the appropriate scope and regulatory position.
